Where the Regulation places you
High-risk under Annex III, point 3, are AI systems intended “to determine access or admission or to assign natural persons to educational and vocational training institutions at all levels” (point (a)) and “to evaluate learning outcomes, including when those outcomes are used to steer the learning process” (point (b)): a platform that grades a student or adapts their path is in.
The school’s administrative tools — enrolment, invoicing, communication with families — are outside that point. Its points (c) and (d) — the appropriate level of education, and detecting prohibited behaviour during tests — are also high-risk: the linked post goes through them.
Obligation applicable from 2 December 2027 (Article 26, for high-risk systems under Annex III; Article 113, third paragraph, point (c), as worded by Regulation (EU) 2026/1744) — preparation recommended.
What to do today: inventory the assessment and personalisation platforms, document the teacher’s oversight of each outcome and, with minors’ data, assess the Article 35 GDPR impact assessment.
